A college student struck while walking may face medical, academic, work, and insurance questions at once. The claim should document the crossing itself and the student’s particular circumstances rather than rely on general statements about campus pedestrian risk.
Preserve the crossing evidence
Record the exact location, direction, signal or traffic control, lighting, and vehicle movement. Identify witnesses who saw the approach and any nearby business, transit, campus, or residential cameras. Request preservation promptly; footage may not remain available.
A campus incident report can be useful, but identify any separate police report and the agency responsible for the roadway. Do not assume a crosswalk or university location determines fault without reviewing the actual controls and conduct.
Organize the student-specific records
- Class schedules, attendance, accommodation requests, and documented academic disruptions.
- Employment records and medical restrictions supporting any lost-income claim.
- Treatment records, bills, prescriptions, and travel or assistance expenses.
- Actual residence and household information, vehicle registration, and relevant auto or health policies.
- Correspondence with campus offices, insurers, and care providers.
Residence can matter to benefit eligibility
An out-of-state student’s eligibility should not be assumed from enrollment, a campus address, or a parent’s policy alone. See out-of-state resident coverage questions. Determine the correct insurer and available benefits separately from a claim against a responsible driver.
Partial fault requires the correct rule
For motor-vehicle noneconomic damages, exactly 50% fault is different from more than 50%. Other requirements still apply, and the rule is not a blanket bar governing all PIP benefits. See the comparative-fault explanation.
Our pedestrian accident practice page covers representation. If the injured student is under 18, minor-settlement procedures may also matter.

Frequently Asked Questions
Does university enrollment establish Michigan PIP eligibility?
No. Residence, policies, registration, and the statutory rules require review.
Can missed classes support the injury record?
They can help describe the actual disruption, especially with medical and accommodation records. They do not automatically establish a dollar award.
