Another great result for our clients! The Michigan Court of Appeals affirmed the Washtenaw County Trial Court’s finding that Farm Bureau Insurance unreasonably denied no-fault benefits for an accident victim and that sanctions were warranted against Farm Bureau. Of most significance was the Court’s statement that an insurance company could not control the medical care of the injured party. The Court of Appeals stated:
“Insurance companies are not qualified to dictate an insured’s course of medical treatment. The right to prescribe an insured’s medical treatment belongs exclusively to an insured’s treating medical providers. An insurance company has no authority to order an insured to enter into a detoxification program or to condition payment of an insured’s no-fault benefits on successful detoxification.”
The injured party was represented by Adrienne Logeman of the Logeman, Iafrate & Logeman, PC law firm. Click here to view the entire opinion.
